Overtime Laws by State (2026)
Every state's overtime trigger, daily rule, double-time rule, seventh-day premium and exempt-salary floor, with the statute and the agency source. Data as of October 25, 2026.
* Kansas (46) and Minnesota (48) thresholds apply only to employers not covered by the FLSA; FLSA-covered employers pay after 40. † Nevada daily overtime applies only to employees earning under 1.5x the state minimum wage ($18.00/hour). Exempt salary floors are the minimum for the executive/administrative/professional exemptions; a duties test must also be met.
Reading the table
Weekly is the hours-per-workweek trigger for time-and-a-half. Daily is a per-day trigger that applies regardless of weekly hours. 2x is double time. 7th day marks states with a premium for working all seven days of a workweek. Where a state has no overtime statute, the federal Fair Labor Standards Act governs and the table shows federal values.
